Son article 68 apporte une modification majeure concernant les cessions de parts de soci\u00e9t\u00e9s \u00e0 pr\u00e9pond\u00e9rance immobili\u00e8re, dont celles de soci\u00e9t\u00e9s civiles immobili\u00e8res (SCI).<\/p>\n\n\n\n<p>Toute cession devra d\u00e9sormais \u00eatre formalis\u00e9e, notamment aupr\u00e8s d&rsquo;un notaire, sous peine d&rsquo;\u00eatre consid\u00e9r\u00e9e comme invalide.<br>\u00ab Le notariat note avec satisfaction la mise en place de cette nouvelle r\u00e8gle de droit, qui renforce la s\u00e9curit\u00e9 juridique de ces transactions et r\u00e9pond aussi \u00e0 un enjeu de lutte contre le blanchiment. C&rsquo;est un v\u00e9ritable tournant. \u00bb se f\u00e9licite Me Bertrand Savour\u00e9, Pr\u00e9sident du Conseil sup\u00e9rieur du notariat. \u00ab Les Notaires de France alertaient les pouvoirs publics depuis de nombreuses ann\u00e9es sur les distorsions juridiques entre les cessions de biens immobiliers d&rsquo;une part et les cessions de parts des soci\u00e9t\u00e9s immobili\u00e8res d&rsquo;autre part \u00bb rappelle Me Pierre Jean Meyssan, Premier Vice-Pr\u00e9sident du Conseil sup\u00e9rieur du notariat.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Une s\u00e9curit\u00e9 juridique renforc\u00e9e<\/h2>\n\n\n\n<p>La loi pr\u00e9voit que, \u00e0 peine de nullit\u00e9, ces cessions doivent \u00eatre r\u00e9alis\u00e9es par acte authentique, \u00e9tabli par un notaire, ou par acte contresign\u00e9 par un avocat. Elles peuvent aussi \u00eatre r\u00e9dig\u00e9es par un expert-comptable, \u00e0 condition que cette cession soit le prolongement direct de sa mission principale d&rsquo;expertise comptable de la soci\u00e9t\u00e9. Pourquoi solliciter un notaire ?
