Comment faire ?<\/p>\n\n\n\n<p>Plusieurs raisons peuvent motiver le choix de r\u00e9aliser une division parcellaire : vendre une partie de son terrain pour financer tout ou partie de sa propre construction, lancer une deuxi\u00e8me construction \u00e0 des fins locatives, mais aussi s\u2019installer \u00e0 deux familles pour r\u00e9aliser des \u00e9conomies .<\/p>\n\n\n\n<p>Plusieurs r\u00e8gles doivent en revanche \u00eatre respect\u00e9es : le terrain doit faire au moins 300&nbsp;m\u00b2, il faut \u00e9galement consulter le PLU (Plan Local d\u2019Urbanisme) de la commune concern\u00e9e pour conna\u00eetre le zonage du terrain ou \u00e0 d\u00e9faut le R\u00e8glement National d\u2019Urbanisme si la commune n\u2019a pas de PLU.<\/p>\n\n\n\n<p>D\u2019autres documents peuvent \u00eatre n\u00e9cessaires pour obtenir la division parcellaire tels que le PPRI (Plan de Pr\u00e9vention des Risques d\u2019Inondation) ou une autorisation des Architectes de France, si le terrain est situ\u00e9 \u00e0 moins de 500 m\u00e8tres d\u2019un site class\u00e9.<\/p>\n\n\n\n<p>Attention, toutefois, certains cas rendent la division impossible : forte d\u00e9clivit\u00e9, implantation du b\u00e2ti existant&#8230; Ensuite, d\u00e8s lors qu\u2019il y a division, il y a cr\u00e9ation de lotissement. Et pour cela, 5 documents sont n\u00e9cessaires : Certificat d\u2019urbanisme op\u00e9rationnel (pour la viabilit\u00e9 de la division), certificat d\u2019urbanisme g\u00e9n\u00e9ral, d\u00e9claration pr\u00e9alable de lotissement, permis de construire et permis valant division.<\/p>\n\n\n\n<p>La division sera d\u00e9finitive \u00e0 l\u2019\u00e9dition du proc\u00e8s verbal de bornage. Cette d\u00e9cision act\u00e9e, la nouvelle parcelle est inscrite au cadastre.
